Terms of Service

These Terms of Service (“Terms”) govern your use of the website and online booking service operated by Black Swamp Totes (“Black Swamp Totes,” “we,” “us”). By booking or renting equipment, you agree to these Terms and to the rental agreement you sign at checkout. If you do not agree, do not use the service.
1. Use of the booking platform
You must be at least 18 years old and able to enter a binding contract. You agree to provide accurate information and to use the site only for lawful purposes. We may refuse or cancel a booking at our discretion (for example, suspected fraud, unsafe use, or equipment unavailability). We currently deliver throughout Toledo, Bowling Green, Maumee, Perrysburg, Sylvania, Oregon, and Northwood; contact us about service to areas outside this region.
2. Booking and payment
The full rental balance is charged at the time of booking via our payment processor, Stripe. Prices are shown before you confirm and include applicable Ohio and Lucas County sales tax. Where a refundable security deposit applies, it is collected as a separate line item at checkout.
3. Rental agreement & e-signature
Before payment, you must review and electronically sign the rental agreement for the equipment you are renting. Your typed name, optional drawn signature, and the date, time, and IP address of signing are recorded. The signed agreement is binding under the federal E-SIGN Act and Ohio’s Uniform Electronic Transactions Act, and its terms govern the rental alongside these Terms.
4. Cancellation policy
- More than 48 hours before delivery: cancel for a full refund of the rental balance.
- Less than 48 hours before delivery (rental not started): a 50% refund of the rental balance applies.
- No-show / after the rental window has started: no refund.
Any refundable security deposit is returned in full on cancellation regardless of timing. You can cancel within your window from the Manage a Booking page or by calling (419) 972-1669. Refunds are issued to your original payment method and typically post in 3–5 business days.
5. Customer responsibilities
You are responsible for: providing accurate delivery and pickup addresses and reasonable access for our team; using the bins for household moving purposes only; keeping the bins in your care during the rental; and returning every bin empty and reasonably clean. You are liable for lost or damaged bins as described below.
6. Prohibited items & uses
The bins are for household moving purposes only. You may not use them for trash disposal, hazardous or flammable materials, liquids, or commercial storage beyond the rental period. Misuse may result in additional charges, including cleaning fees of up to $50 for contaminated bins.
7. Late return
Bins must be available for pickup on the scheduled pickup date. If you need more time, extensions are billed automatically at $0.30 per bin per day to the card on file. Lost or damaged bins (including cracked or broken lids) are charged at $35.00 per bin to the card on file.
8. Security deposit
Where a refundable security deposit applies, it is authorized/collected at booking and returned after the equipment is inspected and returned in good condition. We may deduct from the deposit for damage, cleaning, prohibited items, excess tonnage, missing equipment, or late return. If charges exceed the deposit, the difference may be charged to the card on file. You will receive an itemized summary of any deductions.
9. Limitation of liability
To the fullest extent permitted by law, Black Swamp Totes is not liable for any indirect, incidental, special, consequential, or punitive damages, or for property damage, personal injury, or losses arising from your use of the equipment. Our total liability for any claim relating to a rental shall not exceed the amount you paid for that rental. The equipment is provided “as is” to the extent permitted by law; you are responsible for inspecting it before use and reporting any concern before towing or loading.
10. Indemnification
You agree to indemnify and hold Black Swamp Totes harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the equipment, your violation of these Terms or the rental agreement, or your violation of any law or third-party right.
11. Governing law & venue
These Terms and any rental are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules. Any dispute shall be brought exclusively in the state or federal courts located in Lucas County, Ohio, and you consent to that venue and jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. The “last updated” date reflects the most recent change. Your continued use of the service after a change constitutes acceptance of the updated Terms.
